TERMS AND CONDITIONS

Fit 2 Stretch, Massage & Stretch Therapy LLC. (Fit 2 Stretch) is independently owned and operated. Membership and Wellness Packages are with the person and/or entity that owns the location.

FIT 2 STRETCH IS NOT A PARTY TO ANY MEMBERSHIP AGREEMENTS. AT NO TIME SHALL YOU HAVE A RIGHT TO, NOR SHALL YOU, ASSERT OR BRING ANY CLAIM, DEMAND, OR LEGAL ACTION AGAINST F2S OR ANY OF ITS AFFILIATES RELATING TO YOUR MEMBERSHIP OR WELLNESS AGREEMENT OR THE SERVICES PROVIDED UNDER THE AGREEMENT. NEITHER F2S NOR ANY OF ITS AFFILIATES SHALL HAVE ANY LIABILITY FOR (i) ANY OBLIGATIONS OR LIABILITIES RELATING TO OR ARISING FROM YOUR MEMBERSHIP AGREEMENT; (ii) ANY CLAIM BASED ON, IN RESPECT OF, OR BY REASON OF THE RELATIONSHIP BETWEEN YOU AND US; OR (iii) ANY CLAIM BASED UPON ANY ALLEGED UNLAWFUL ACT OR OMISSION BY THE FRANCHISEE OR ANY INDEPENDENTLY OWNED AND OPERATED FIT 2 STRETCH LOCATION.

MEMBERSHIP PRICE CHANGES

Following the initial term of your membership, Fit 2 Stretch will give you 30 days advance written notice of any increase in the monthly payment (or membership dues) under your membership or agreement.

SERVICE DETAILS AND REQUIREMENTS

To the best of the Fit 2 Stretch knowledge, only professional massage and stretch therapist who comply with state, city, and/or local licensing or certification requirements are hired by Fit 2 Stretch. Ask the Fit 2 Stretch location if you would like to see a particular massage therapist’s license or certification. You understand that the services Fit 2 Stretch provides are not a replacement for medical care, should not be used as a substitute for medical examination, diagnosis, or treatment, that no medical diagnosis will be made, and that you should see a medical provider for any medical issues you may have. It is your responsibility to inform the Fit 2 Stretch location of any pre-existing conditions, limitations, or specific sensitivities.

Male/female genitalia and women’s breasts will not be exposed or massaged at any time. Modest draping will be used during each of your services unless if the service does not require draping. If you do experience discomfort, pain or are uncomfortable for any reason during a service, you agree to immediately ask the therapist to adjust the manipulation, draping, pressure, heat, or environment (or, if you prefer, you can ask the therapist to end the service at any time). If the therapist is unable to relieve your discomfort after you request an adjustment, you will inform the therapist you would like to end the service immediately. If you have any concerns about your therapist, you agree to bring it to the attention of the Fit 2 Stretch location rendering the service immediately following your service. Inappropriate or illegal conduct will not be tolerated in any manner. Fit 2 Stretch may, in its sole discretion, refuse or discontinue a service if it determines such service may be unsafe, cause discomfort for you or if you engage in any inappropriate conduct as determined by Fit 2 Stretch in its sole discretion.

TERMS AND CONDITIONS

Fit 2 Stretch, reserves the right to terminate or refuse to renew your agreement for any reason not prohibited by law including, but not limited to, an unsatisfactory payment history. Fit 2 Stretch reserves the right to collect at any time any delinquent or outstanding balance(s) that has not been paid for any services provided or monthly payments owed. For purposes of identification and billing, you agree to provide Fit 2 Stretch with current, accurate, complete, and updated information including your name, address, telephone number, and applicable payment data. You agree to notify Fit 2 Stretch promptly of any changes in your information, including your payment data.

Fit 2 Stretch may delay enforcing any of its rights without losing them. Fit 2 Stretch can enforce the membership or Wellness Package Agreement against your heirs and legal representatives, and may assign or transfer such agreement or any rights under it without notice to you, except as otherwise required by law. Your rights or obligations under the membership or Wellness Package Agreement cannot be assigned by you to anyone else without prior written consent of Fit 2 Stretch. In the event of closure of their independently owned and operated location, you will be directed to another Fit 2 Stretch location. The invalidity or unenforceability of any provision of your membership or Wellness Package Agreement shall not affect the validity or enforceability of any other provision of the agreement, which shall remain in full force and effect. You understand and agree that your membership or Wellness Package Agreement does not grant you the privilege of exclusive or preferred access to the location or to any service offered at Fit 2 Stretch. You or any other individual may obtain access to and purchase any and all services offered by Fit 2 Stretch without entering into an agreement, and you understand that your membership or Wellness Agreement only entitles you to the benefits set forth therein.

WELLNESS PACKAGES

  • I understand that if I am unsatisfied with the Wellness Package I have chosen, I MUST cancel within 48-72 hours of my purchase.
  • I understand that if I need to reschedule/cancel an appointment, I MUST do so within 24 hours or I will lose that session.
  • I understand that I have 8 Months from purchase to use my Wellness Package (UNLESS OTHERWISE STATED) FAILURE to do so, will cause package to expire.
  • I understand that all PROMOTIONS have 8 Months from purchase to used FAILURE to do so, will cause promotion to expire.

GIFT CERTIFICATES

FIT 2 STRETCH Gift Cards and E-Gift Certificates should be treated as cash. All sales are final; Gift Cards and E-Gift Certificates cannot be exchanged or refunded for any reason. To provide maximum protection to your credit card account, and to provide maximum protection to your credit card account, and to allow time for your order to process, our printable Gift Certificates become active and may be redeemed 24 hours after purchase. Gift Cards and E-Gift Certificates contain value that may be used to purchase merchandise and services, however they cannot be used to purchase other gift cards or e-gift certificates.

Please present your FIT 2 STRETCH Gift Cards E-Gift Certificates upon departure and your sale will be deducted from your card’s balance. All remaining balance must remain on your card; no cash value; cannot be redeem for cash. FIT 2 STRETCH is not responsible for cards that are lost, stolen, damaged or used without authorization. FIT 2 STRETCH Gift Cards and E-Gift Certificates are the property of FIT 2 STRETCH. If you have any inquiries please write to us at emailus@fit2stretch.com.

THESE TERMS AND CONDITIONS MAY BE MODIFIED AND APPLY AT EACH VISIT TO ANY FIT 2 STRETCH LOCATION.

GROUPON VOUCHER USE POLICIES

Expiration Dates - As a customer you have have until the expiration date to schedule and USE your voucher before the expiration date. We encourage all customers to schedule their appointment/appointments 3-4 weeks in advance. After that date, you will owe FIT 2 STRETCH the difference of the retail value of the service and the price that you paid towards your voucher. Or the amount that you pay on your voucher can be applied towards ANY service that Fit 2 Stretch locations offer. Valid vouchers MUST be used at the location of purchase.

Repeated Use- Unless directly specified on the voucher, repeatedly using a Groupon voucher to visit one of our FIT 2 STRETCH locations is a violation of the voucher’s Fine Print. The Fine Print is a legally agreed upon set of behavior that Groupon requires both the merchant and customer to observe. Our FIT 2 STRETCH locations are not required to honor repeated voucher use. Refunds - All refunds are administered by Groupon. Please contact Customer Support team at support@groupon.com or groupon.com/help

Taxes - Groupon vouchers are subject to local taxes.
